Except as specifically provided herein, Rainforest Connection makes no warranty of any kind, express or implied, with respect to this product.

OPERATIONAL WARRANTY

This warranty applies for the first ninety (90) days from the date of installation. RFCx warrants that the Guardian(s) will be installed without manufacturer defect, diagnostic systems are functional, data is successfully transmitted, solar panels and other equipment is installed correctly. This warranty only applies if the ground conditions are met (not limited to but including) GSM signal connectivity, viable weather conditions, access to enough sunlight for solar panel charge, restricted access to non-RFCx staff, not subjected to small animals, rodents, termites’ attacks. If the ground conditions are not met, then the RFCx Guardian(s) are installed with the customer acknowledging and accepting the risks associated with the installation.

 

LIMITED HARDWARE WARRANTY

RFCx warrants that the Guardian will be free from defects in workmanship and materials, under normal use for a period of (12) months. The limited hardware warranty will only cover defects or faults caused by manufacturing or workmanship errors made by RFCx (see exclusions section below).

Successful execution of each project assumes that all installed RFCx Guardian(s) remain fully functional and free of manufacturer defects for much longer than 12 months.

SOFTWARE WARRANTY

RFCx warrants that any RFCx deployed software will perform in substantial conformance to required specifications for a period of twelve (12) months from the date of the installation. RFCx makes no warranty or representation that the operation of the software products will be uninterrupted or error free, or that all defects in the software products will be corrected. 

 

EXCLUSIONS

The terms of Limited Hardware Warranty excludes (1) physical damage to the surface of the product, including cracks or scratches on the outside enclosure; (2) damage caused by misuse, unauthorized attempts to open, repair, or modify the product, or any other cause beyond the range of the intended use; (3) damage caused by accident, fire, power changes, other hazards, acts of God, or extreme weather events; or (4) use of the product with any non-RFCx device or service if such device or service causes the problem. No warranty is provided by RFCx unless the product was purchased from RFCx.

Replacement or repairs for the aforementioned exclusions are covered in the RFCx Annual Maintenance Contract.

 

EXCLUSIVE REMEDIES

Should a covered defect occur during the warranty period and you notify RFCx, your sole and exclusive remedy shall be, at RFCx’s sole option and expense, to repair or replace the product or software. If RFCx cannot reasonably repair or replace then RFCx may, in its sole discretion, refund the purchase price paid for the product. Replacement products or parts may be new or reconditioned or comparable versions of the defective item.  

 

AUXILIARY WARRANTY: ANNUAL MAINTENANCE CONTRACT (AMC)

The Annual Maintenance Contract (AMC) is the most cost-effective means to protect the customer from additional repairs or replacements caused by conditions excluded in the Limited Hardware warranty. The AMC covers Hardware components damaged by conditions excluded in the Limited Hardware Warranty and will ensure RFCx provides replacement components.

The Annual Maintenance Contract includes one (1) scheduled visit each year (for the duration of the AMC to replace or repair RFCx Guardians malfunctioning due to conditions excluded in the limited hardware warranty. The AMC is excluding the cost of travel and accommodation which is borne by the customer. This condition is deemed null and void if the RFCx Guardians are meeting the hardware and software warranty conditions. Additional considerations are mentioned below:

Warranty services can be availed through any of the approved channels. 

All requests for warranty service authorization must be made within the applicable warranty period. Eligibility will need to be verified. 

Products or parts shipped by customer to RFCx must be sent postage-paid and packaged appropriately for safe shipment. 

RFCx is not responsible for Customer products received without a warranty service authorization and may be rejected. 

Repaired or replacement products will be brought to the customer via a trained RFCx employee and installed by them.

All products or parts that are replaced become the property of RFCx.

RFCx shall not be responsible for customer software, firmware, information, or memory data contained in, stored on, or integrated with any products returned to RFCx for repair, whether under warranty or not. 

The repair and replacement process for products or parts in locations outside of the United States will vary depending on Customer’s location.

LIMITATIONS OF LIABILITY

Neither RFCx nor its suppliers shall be liable for incidental, consequential, indirect, special, or punitive damages of any kind, loss of information or data, loss of revenue, loss of business or other financial loss arising out of or in connection with the sale or use of this product, whether based in contract, tort (including negligence), strict product liability orany other theory, even if RFCx has been advised of the possibility of such damages and even if any limited remedy specified in this licence agreement is deemed to have failed of its essential purpose. RFCx’s entire liability shall be limited to replacement, repair, or refund of the purchase price paid, at RFCx’s option. in no event shall RFCx’s liability for all damages related to the purchase of product exceed the amount paid for the applicable product. the foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

DISCLAIMER

Given the intense and unpredictable environmental conditions of most forest areas, it is not uncommon that hardware issues arise over time in certain installations. 

It is understood that the customer in all circumstances will always comply with all statutes, laws, ordinances and government rules and regulations to which it is subject. Noncompliance with which could have a material adverse effect on the project deliverables.

GOVERNING LAW

This Limited Warranty shall be governed by the laws of California, and by the laws of the United States, excluding their conflicts of laws principles. The United Nations Convention on Contracts for the International Sale of Goods is hereby excluded in its entirety from application to this Limited Warranty.

PROHIBITION AGAINST EAVESDROPPING

United States law (Federal Communications Commission Part 15 Section 15.9) states “Except for the operations of law enforcement officers conducted under lawful authority, no person shall use, either directly or indirectly, a device operated pursuant to the provisions of this Part for the purpose of overhearing or recording the private conversations of others unless such use is authorized by all of the parties engaging in the conversation.” You are responsible for complying with all applicable laws within your jurisdiction.
